The Greenland restrictive measures regime
The Greenland restrictive measures regime is the sanctions architecture adopted by the European Union on 27 January 2026 and given its designation annex on 2 February. It is the first sanctions regime the Union has ever directed at the United States, and it works not by prohibiting American conduct but by removing the commercial services — ports, insurance, and payments — without which the American Arctic supply line cannot operate.
The three prohibitions and the listing power
- Ports. Any vessel that has called at a port under American military operational control in Greenland since 19 January is barred from every EU port and anchorage. The rule is retrospective and follows the vessel, not the voyage.
- Insurance. EU-based insurers — including the London and Nordic protection-and-indemnity clubs that write most of the world's ocean hull cover — may not insure, finance, or service such vessels, or any vessel in the American Arctic lift.
- Payments. EU banks and clearing houses may not process payments for the carriage, bunkering, or servicing of Arctic-bound American government cargo.
- Designations. The Council lists third-country shipping companies, bunker suppliers, agents, and logistics firms that materially assist the Greenland operation. A humanitarian exemption covers food, medicine, and civilian supply for Greenland.
What the room refused
Three officials present record that the sharpest proposal on the table — a general prohibition on American military aircraft and vessels using any EU or member-state infrastructure — was dropped after the German and French delegations warned it would be "a blockade, drafted and signed." A proposal to designate senior American officials by name was set aside and held in reserve.
The Baltic states and the Netherlands pushed for the total ban and lost. Estonia registered a minority statement that the package as adopted "measures the rope while the arson is at the door" — the sentence that gave the period its name.
The Hungarian hole
Péter Szijjártó stood and repeated two sentences: "Hungary will not impose sanctions on American citizens or American companies." Budapest abstained, which under the unanimity rules does not block adoption, and then announced it would not implement the measures. The Council noted the position and deleted nothing. A member state openly refusing to apply a common foreign-policy decision is a hole the institutions have not yet confronted.
The unanswered question
The drafters deliberately declined to say how a port ban would be enforced against a United States Navy warship in European waters. Sovereign grey hulls remain governed by separate military rules of engagement, and port state control authorities were given interdiction powers only over commercial vessels.
The first warship to test it will settle the question by precedent. As of the end of the record, none has.
Effect
Two heavy-lift ice-class freighters under charter to the Department of Defense — the Liberian-flagged Polar Starling and the Panamanian-flagged Nordic Trader, both en route from Halifax to Nuuk — had their indemnity certificates revoked by their Scandinavian underwriters while at sea, forcing emergency sovereign indemnity declarations to stop civilian crews refusing to sail.
Combined with the basing lockout, the regime left the American northern position dependent on a single 3,200-nautical-mile domestic air bridge.
